Terms of Service

These Terms of Service ("Terms") govern your access to and use of the McBride Family Productions platform ("MFP", "we", "us") including the website at mcbridefamily.net, the guest song request interface at requests.mcbridefamily.net, and the Backstage portal at backstage.mcbridefamily.net.

By using any part of the platform you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these Terms. You must not:

Submit content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable
Impersonate any person or entity
Attempt to gain unauthorized access to any part of the platform
Introduce viruses, malware, or other harmful code
Use automated tools to scrape, crawl, or stress-test the platform without permission
Attempt to circumvent rate limits, access controls, or security measures
Use the platform for spam, phishing, or any commercial purpose not expressly permitted

2. User Responsibilities

As a platform user (guest, host, or administrator), you are responsible for:

Maintaining the confidentiality of your login credentials
Any activity that occurs under your account
Ensuring that any content you submit complies with applicable laws and these Terms
Promptly notifying us of any unauthorized use of your account

3. Event Host Responsibilities

If you use the platform as an event host:

You are responsible for ensuring guests understand how their data will be used
You must not use the platform to collect information from guests in a deceptive manner
You are responsible for the lawful operation of your event
You agree to use any collected guest data (such as song requests) only for legitimate event management purposes

4. Song Requests and Guest Submissions

Song requests and messages submitted through the guest request interface:

Are visible to the DJ and event organizers in real time
May be moderated, approved, declined, or removed at the discretion of the DJ or platform administrators
Should not contain offensive, harassing, or inappropriate content

5. Audio Submissions and Talkback

If the platform includes audio talkback or voice submission features:

Recordings may be reviewed by platform staff
Recordings that violate these Terms may be removed without notice
By submitting an audio recording you grant MFP a limited license to store and play back the recording as part of the event

6. Content Moderation

We reserve the right to review, moderate, remove, or decline to display any user-submitted content that we determine, in our sole discretion, violates these Terms or is otherwise harmful or inappropriate. This includes song requests, messages, talkback submissions, and uploaded files.

7. Intellectual Property

The McBride Family Productions name, logo, and platform design are our intellectual property. You may not reproduce, distribute, or create derivative works without our prior written consent.

Song titles, artist names, and music metadata displayed on the platform are the property of their respective rights holders. The platform facilitates requests and does not reproduce copyrighted audio content.

8. Payments and Tipping

If the platform includes tipping or payment features:

Payments are processed through Stripe, a third-party payment provider
By making a payment, you also agree to Stripe's terms of service
All transactions are final except where required by law
We are not responsible for payment processing errors caused by third-party providers

9. Account Suspension and Termination

We reserve the right to suspend or terminate access to the platform for any account that:

Violates these Terms
Engages in abusive, fraudulent, or illegal conduct
Poses a security risk to the platform or other users

Suspended or terminated users may appeal by contacting support@mcbridefamily.net.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, McBride Family Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of California.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted with a revised effective date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
